Under HIPAA’s Privacy Rule (45 CFR §164.524), you have the legal right to access your medical records, including hearing tests. This rule requires healthcare providers to provide patients with copies of their protected health information (PHI) upon request. Once a hearing test is completed, your audiologist or provider must comply with this statute and cannot withhold your records or charge you again for a service that has already been rendered. Providers can only charge a reasonable, cost-based fee for copying, supplies, or postage if they mail the records, but cannot charge for time spent locating or retrieving the test, or for the test itself if the test was initially free!

Providers are not allowed to retroactively charge for services that were originally provided for free. Charging a fee for accessing records that was not part of the original agreement for services, especially when the services were free, would violate the principles of HIPAA and could potentially be illegal.
